Should a court award damages to a former model whose sexy photo is used in a movie without her permission?

A ravishing Russian is suing the makers of the Vince Vaughn movie “Couples Retreat” for using an old modeling picture in a raunchy scene.

Former model Irina Krupnik posed for the sexy bikini shot in February 2001, but contends she was horrified when clients told her they had recognized her from the 2009 comedy.

“It was not a welcome development,” said Thomas Mullaney, a lawyer for the 31-year-old stunner, who is now a makeup artist.

“That’s really a trashy way to treat somebody.”

In the scene, actor Jon Favreau’s overweight, unhappily married character waits for his wife to leave their hotel room before enjoying a private moment with Krupnik’s picture.

The $10 million suit in Manhattan Supreme Court charges that Universal Pictures co. never obtained permission before using the stock image in the movie.

“Common decency means you should ask somebody before you put them into a scene that’s essentially pornography,” Mullaney said.
